26 States File Lawsuit Against Obama’s Executive Amnesty

Up to December 10 a total of 24 States have Filed a Lawsuit Against Obama’s Executive Amnesty. Expect the number of states joining this lawsuit to rise over the next weeks. Originally 18 states, led by Texas, filed a lawsuit with the U.S. District Court in the Southern District of Texas challenging President Obama’s executive action on immigration. The suit claims that the White House overstepped its authority by granting amnesty and work permits for 5 million illegal aliens.
After filing the federal suit, Texas Attorney General and Governor-elect Greg Abbott wrote in a statement that President Obama’s executive amnesty “tramples the U.S. Constitution’s Take Care Clause and federal law.”
Also included in Attorney General Abbott’s statement were the states’ legal challenges to President Obama’s executive action:
• The executive action on immigration conflicts with the President’s constitutional duty to “take Care that the Laws be faithfully executed.” The Take Care Clause limits the scope of presidential power and ensures that the chief executive will uphold and enforce Congress’s laws – not unilaterally rewrite them under the cover of “prosecutorial discretion.”
• The DHS Directive failed to comply with the Administrative Procedure Act’s required notice and comment rulemaking process before providing that legal benefits like federal work permits, Medicare, and Social Security be awarded to individuals who are openly violating immigration laws.
• The executive action to dispense with federal immigration law will exacerbate the humanitarian crisis along the southern border, which will affect increased state investment in law enforcement, health care and education.
The other states involved in the suit include: Alabama, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Mississippi, Montana, Nebraska, North Carolina, South Carolina, South Dakota, Utah, West Virginia and Wisconsin.
UPDATE: Arizona has joined the lawsuit. In a statement, Arizona Governor Jan Brewer said, “Obama has exceeded his power as clearly defined in the United States Constitution and federal law and deliberately ignored the will of the American people. Such federal overreach cannot stand.”
Florida has joined the lawsuit. In a statement, Florida Attorney General Pam Bondi said, “The President repeatedly said he would not violate the law, then decided to do just that. The powers granted to the President are expressly laid out in the United States Constitution, yet President Obama has decided to ignore those parameters.”
As of December 10, Arkansas, Michigan, North Dakota, Ohio and Oklahoma have also joined the lawsuit.

The governors’ claim is in a 75-page document filed in a Texas federal district court that states “This lawsuit is not about immigration. It is about the rule of law, presidential power and the structural limits of the U.S. Constitution.” President Obama’s unilateral immigration action, which was presented November 20, would allow for work permits and tentative status to nearly five million illegal immigrants, and would protect many others from deportation. However, those not included would not have the same legal standing as the five million officially granted the amnesty.
The governors have said that their reasoning for suing is due to the cost and responsibility that comes with allowing five million people to stay. Their state taxpayers would be required to pay for the expenses entailed with schooling, health care, and police to handle a sudden influx of illegal border crossings. Texas is joined in the lawsuit by the states Alabama, Georgia, North
Carolina, South Carolina, Mississippi, Louisiana, West Virginia, Maine, Nebraska, Kansas, Idaho, Indiana, Montana, Utah, Wisconsin and South Dakota. Attorney General Greg Abbot of Texas leads the charge of spurring lawsuits against immigration amnesty by President Obama. Mr. Abbot has challenged the Obama administration 31 times and this will be his 34th against the federal government. This current lawsuit is being utilized by Republicans as a temporary method to stall President Obama’s amnesty action through the courts.


These actions severely undermine and damage our republic, not to mention the massive economic costs involved.
Obamas amnesty will surely create another ‘wave’ of illegal immigration, the likes of which we have never before seen!

  1. February 17, 2015 A federal judge in Texas has blocked President Barack Obama’s unilateral and unpopular November plan to award work permits to four million illegal immigrants, starting this week.
    The late-night injunction will scramble the Senate’s immigration stand-off, and could help conservative Republicans push confident Democrats on the defensive — if it is not quickly reversed by appeals court judges.
    The lawsuit was filed by 26 states, and is expected to be decided by the Supreme Court in 2016.
    “President Obama abdicated his responsibility to uphold the United States Constitution when he attempted to circumvent the laws passed by Congress via executive fiat, and Judge Hanen’s decision rightly stops the president’s overreach in its tracks,” reads a statement from Republican Texas Gov. Greg Abbott.
    “We live in a nation governed by a system of checks and balances, and the president’s attempt to bypass the will of the American people was successfully checked today,” he continued.
    The 123-page judgment ruled that Obama’s November amnesty violated the Administrative Procedure Act by ignoring Congress’s laws.
    The amnesty also improperly imposed burdens on the states, ruled Judge Andrew S. Hanen, of the Federal District Court in Brownsville. “The court finds that the government’s failure to secure the border has exacerbated illegal immigration into this country. … The record supports the finding that this lack of enforcement, combined with the country’s high rate of illegal immigration, significantly drains the states’ resources.”
    Hanen was nominated in 2002 by then-President George W. Bush.
    The injunction is needed, Hanen declared, to stall the amnesty while the lawsuit is debated by various appeals courts.
    “The court agrees … any subsequent ruling that finds DAPA unlawful after it is implemented would result in the states facing the substantially difficult — if not impossible — task of retracting benefits or licenses already provided” to beneficiaries, he wrote.
    Obama’s executive order is intended to award work permits, tax rebates, Social Security cards, and a quick route to citizenship to four million of the 12 million illegal immigrants in the United States. The process would have helped the four million — and their children and spouses — gain deeper roots in the United States.  The Department of Homeland Security was supposed to begin the amnesty process on Feb. 18.
    The decision also blocked Obama’s announced expansion of his 2012 policy of awarding work permits to younger illegal immigrants. So far, Obama’s 2012 amnesty has allowed almost 700,000 illegals to compete against Americans for jobs in a lagging economy.

We must make a LOUD statement and vote for someone that will put USA Citizens first in their country.  President Obama, Clinton, and Sanders all want open boarders and a One World Order this will be the fall of USA as we know it.  Our Tax Dollars should be for Our Tax Problems and immigration wouldn't be a problem if our elected politician simply DID THERE JOB and deported those here illegally.

  5. It is clearly evident that President Obama has taken on the role of an Imperial President or as some have put it the first American dictator.  Like it or not America must now adjust to this new government.  

    Although America is no longer a Republic, could it be that we no longer need a Congress?  We must ask ourselves why a Congress is needed when the executive branch now has the authority to create and abolish law as it sees fit.

    Many democrats and liberals are satisfied with the new changes but will they be satisfied if President Obama decides to abolish the democrat party since he really no longer needs them.  As far as the courts are concerned, they basically have no power to stop what the President intends to do.  Any decision by the Federal Courts will simply be ignored.

    The next thing Americans need to consider is what the new changes mean as far as daily life and the understanding that for all intense and purposes the 2016 elections will almost certainly be canceled.

Many people, understandably so, do not want to believe that America is no longer a Republic and that it is led by a dictator who is supported by a propaganda machine called the "media".  In addition, we are not represented by a congress.  In fact, many in congress agree with the first American dictator that the American people already have too many freedoms and need to be subjugated by increased financial burdens.  But the last and maybe the most important part of the collapse of The United States is the fact that our young people know nothing about history except what’s hot on dancing with the stars, fantasy sports or what Justin Bieber did last week and many older Americans are lazy, ignorant and uninterested in their futures or their children's future.  A small percentage of true patriotic Americans voted for a change in 2014 and threw out the destructive liberals but their votes were cast in vain because the newly elected replacements were just as un-American and kept with the liberal anti-liberty policies.  What is happening in this country is so dangerous and evil that it could make the staunchest atheist bend a knee in prayer.  And actually that is what is needed.  We, as a people, must admit to ourselves that we need the help of God if we are ever to move back to sanity and the rule of law.  

  8. How you can sue Obama for granting executive amnesty when he never signed it into existence is beyond me. The media has duped you again. Obama said he would use executive action that does not mean to sign executive order. There is a difference between action and orders.

  10.  December 3 2014; Obama and his administration repeatedly trample us, the American citizens, and further shreds & defiles OUR Constitution. As a counter to the Republican efforts, Minority Leader Nancy Pelosi and other House Democrats are joining forces to create what is called an “Immigration Strike Team.” A message was delivered to many of the spokespeople of prominent caucuses, such as Asian, Black and Hispanic caucuses, and some who have connections with Spanish-language television like Telemundo to give the strike team a bilingual platform. The first conference for the new strike team occurred on the afternoon of December 3, and they will continue to work together as long as needed. A Senate Judiciary Committee Hearing is scheduled for next week, in which the team plans to garner attention to explain the benefits of immigration amnesty by President Obama, despite the spur of lawsuits still pending.

  12. A guy leaves a van running and it's stolen and used in a crime and now he's being charged with something but what who knows. Lets say I leave my garage door open and someone runs in and grabs an ax then runs back home and lops off his wife's head with my ax am I at fault?
